These Terms & Conditions (the “Agreement”) outline the conditions for accessing and using the Appyro platform (www.appyro.app), helping maintain a safe, respectful experience for all users. By accessing Appyro or participating in any services offered, you indicate your agreement to these Terms & Conditions, which are legally binding for all users.

These Terms & Conditions cover the following elements of the Appyro experience:

The Singles Matchmaking Platform – used to collect data from individuals looking for committed relationships and then pair them with the individuals we believe are best suited for them. To do this effectively, we will need to collect data and leverage it for personalization activities, while also monitoring and ensuring a safe online environment.

The Couples Survey – used to collect data from individuals in committed relationships to help us understand what makes successful relationships work and inform our singles algorithm. As an incentive for couples today to provide their data to enhance the experiences of others, we have created our ‘Sweetstakes’ Program.

The ‘Sweetstakes’ Loyalty Program (further referred to as ‘Sweetstakes’ or ‘The Program’) is a loyalty program that allows individuals in committed relationships to have an opportunity to win a myriad of awards, including gift cards and an all-expense paid date night.

To optimize our services, we collect and analyze data provided by users through the Singles Matchmaking Platform and Couples Survey. This data is used to improve the personalization of matches and to gain insights into successful relationships, helping us continuously enhance the Appyro experience in accordance with privacy standards. Please review this Agreement carefully.

As we evolve, these Terms & Conditions may be updated periodically. We will notify you of any significant changes, and your continued use of Appyro following such notifications constitutes acceptance of the revised Agreement. Your Privacy and Data at Appyro

To create the best matchmaking experience possible, we gather information that helps us understand your preferences, values, and relationship goals. This data collection includes responses from singles and couples surveys, interactions on our website, and other input you provide throughout your journey with Appyro.

Here’s how we handle and protect your information with transparency, aligning with GDPR and California privacy laws:

Singles Surveys: We ask questions to understand your background, personality, lifestyle, values, and relationship preferences, enabling us to recommend compatible matches based on meaningful criteria. We will also ask you for user-generated content such as photographs and biographies to ensure strong quality of matches.

Couples Surveys: To improve our compatibility models, we gather anonymized insights from couples on what makes relationships successful. This data helps refine our matching algorithm without compromising your privacy. Questions in this survey are like those found in the singles survey.

Privacy, Consent, and Compliance

We adhere to the strictest standards set forth by the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA). You have rights under these regulations, including access to your data, the ability to request deletion, and the choice to opt out of us leveraging this data to enhance our algorithm. Appyro retains personal data for as long as needed to fulfill the purposes stated in this policy or as required by law. After this period, data is either deleted or anonymized. Users may also request deletion of their data as outlined under ‘Your Rights.’

All information gathered is stored securely in conjunction with Zoho and within our platform. We won’t share your personal data externally without your explicit consent except where required to comply with applicable laws or legal processes. Explicit consent may be obtained when users accept terms at registration, complete a survey, or actively opt in to any new partnerships. Users can withdraw consent anytime by emailing support@appyro.app. If we explore opportunities to use anonymized data for partnerships or advertising, you’ll always have the option to opt out, ensuring your data remains within your control.

 Data Usage and Analysis

 Your data enables our algorithm to provide more tailored recommendations, supporting a high-quality matchmaking experience solely within the Appyro platform. We strive to be the world’s most sophisticated relationship expert, and we are strong believers that data of actual successful matches is the way to do it. Aggregated and anonymized insights from singles and couples may be used to study relationship patterns and improve our compatibility models. These insights help us enhance our services without revealing identifiable information. We have taken measures in our surveys to encrypt sensitive information, and will never share your personally identifiable information. 

Security, Transparency, and Your Rights 

We use industry-standard security practices to safeguard your information, including encryption and limited-access policies. Only authorized personnel access your data, strictly for enhancing your experience and the matchmaking algorithm on Appyro. 

In alignment with GDPR and CCPA, you have the right to: 

Access your data and request information on how it’s processed 

Correct, update, or delete your personal data at any time 

Opt out of data processing for advertising purposes or withdraw consent where applicable 

Be informed promptly of any changes to this policy or any data breaches impacting your information

Internal Data Use and Potential Advertising 

Your privacy and data security are of the utmost importance to us. At Appyro, we collect data from our users to improve matchmaking accuracy and enhance the user experience. The following section describes how we use your data internally and outlines any potential future data sharing with advertisers using aggregated, anonymized information. 

Primary Use of Data for Matchmaking Internal Matchmaking

The primary purpose of the data collected, including information from our Singles Survey and Couples Survey, is to power Appyro’s matchmaking algorithm. Your responses help us understand compatibility, relationship goals, values, and lifestyle factors that contribute to finding meaningful matches. Our matchmaking algorithms operate on anonymized data segments to ensure that no personally identifiable information is used to create, display, or deliver matches. Personal details, such as name, contact information, and any identifiable specifics, are stored securely and separated from the algorithms powering compatibility calculations. 

Anonymized and Aggregated Data for Future Advertising 

In the future, we may work with trusted advertising partners using only aggregated, anonymized data to provide insights into relationship trends. No individually identifiable information will be shared without your explicit consent. Should advertising partnerships be introduced, we will notify you 30 days in advance via email and platform notifications, ensuring you have time to review any updated policies and modify your preferences. Appyro commits to never sharing your personal identity, contact information, or any individually identifiable data with third-party advertisers without your explicit consent. Any potential advertising partnership will strictly adhere to Appyro’s privacy standards, ensuring your identifiable information remains protected. 

Your Right to Opt Out of Data Sharing for Promotional Purposes 

Should advertising partnerships be developed, you will have the choice to opt in or out of data sharing with these advertisers. We will notify you of any new partnerships involving anonymized data and provide you with the ability to update your preferences. We will provide easy-to-navigate consent management settings where you can opt in or out of sharing anonymized data with advertisers at any time. Until this technical capability is available on our digital platforms, please email us directly at support@appyro.app for any request to remove or opt-out of leveraging your data. Please note we will ensure you are able to opt-in prior to any new leveraging of data and will never do so without your consent. 

How Aggregated Data May Be Used 

Aggregated and anonymized data may be used to inform relationship research, improve product features, and report on trends without identifying any individual users. Publications and reports based on this data will always ensure confidentiality. Anonymized insights derived from user data help us innovate and develop new features, creating a more personalized experience for Appyro users without revealing specific user identities. 

From time to time, aggregated data may also be included in reports or publications, such as studies on dating trends or compatibility factors. Any publication of such data will ensure that no user is identifiable and that all personal information remains strictly confidential. 

Compliance with Privacy Standards and Laws

In line with the General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA), Appyro respects your data privacy rights. You have the right to access, modify, and delete your personal data, as well as control how it is shared. Appyro abides by GDPR and CCPA principles, including data minimization (collecting only what’s necessary) and purpose limitation (using data solely for stated purposes), to ensure your data rights are protected. We implement industry-standard data protection practices to secure your data, ensuring compliance with applicable privacy regulations.

Your data is a critical part of creating meaningful and successful matches on Appyro, and we remain committed to using it responsibly, securely, and transparently. User-Generated Content (UGC) Rights 

As part of Appyro’s interactive services, users may upload and share content such as profile pictures, descriptions, personal messages, and other information (“User-Generated Content” or “UGC”). 

By creating and sharing this content on Appyro, you agree to the following terms regarding our use and rights over your UGC: 

License to Use and Display UGC This license is limited to Appyro’s platform, services, and promotional materials, allowing us to use, display, reproduce, modify, and distribute your UGC to facilitate matchmaking, user engagement, and platform integrity. By uploading or sharing UGC on Appyro, you grant Appyro a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, display, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and publicly display your UGC within the Appyro platform and related services. This license allows us to include your UGC in our matchmaking processes, personalize your experience, and display it as part of your profile to other users for compatibility purposes. It also enables us to maintain our platform’s integrity, deliver features, and support user engagement. 

Right to Use UGC in Promotional Materials Appyro may use select UGC (such as profile pictures, testimonials, or other content types) for promotional, marketing, and advertising purposes. This may include featuring UGC on our website, in social media posts, or in other media formats. Promotional use of UGC will always be consistent with Appyro’s brand and respectful of user privacy. However, we will never disclose personally identifiable information, such as your full name or contact information, in any promotional materials without your explicit consent. 

Opt-Out Option for Promotional Use If you prefer not to have your UGC used for promotional purposes outside of the Appyro platform, you have the right to opt out. You may exercise this right by contacting us at support@appyro.app. Upon receiving your request, we will refrain from using your UGC in any future promotional or marketing efforts. Upon receiving your opt-out request, we will process it within 5 business days and refrain from using your UGC in any future promotional or marketing efforts. Please note that opting out of promotional use will not affect the display of your UGC within the Appyro platform itself. UGC will still be used to support matchmaking and facilitate interactions within Appyro, as this is essential to providing our core services. 

Ownership of UGC and Intellectual Property Rights You retain all rights, ownership, and intellectual property in your UGC. Appyro does not claim ownership over your content; instead, the rights you grant allow us to operate our services effectively. You acknowledge that Appyro may, at its discretion, make modifications to your UGC (e.g., resizing images, adjusting formatting) to optimize it for display or compliance with our platform’s requirements. Any modifications to UGC are limited to adjustments for display optimization, such as resizing images, and do not alter the original content or ownership 

Content Standards and User Responsibility You are responsible for ensuring that all UGC you upload or share on Appyro complies with our content guidelines and policies. 

*Prohibited UGC includes, but is not limited to, content that: 

*Violates intellectual property rights or copyrights of any third party 

*Contains offensive, defamatory, or harmful material Is illegal or promotes illegal activity 

*Violates our community guidelines or other Appyro policies 

Appyro reserves the right to remove or moderate any UGC that violates our guidelines or is deemed unsuitable, without notice. Failure to comply with these standards may result in the suspension or termination of your account. 

Data Retention and Removal of UGC 

You may delete or modify your UGC at any time through your account settings. However, by submitting UGC to Appyro, you acknowledge that certain content (such as public comments or profile images shared with others) may remain visible in historical or backup formats within Appyro’s system for a limited period, even after deletion. Additionally, Appyro may retain anonymized versions of your UGC for data analysis, platform improvement, or research purposes, in accordance with applicable laws and privacy standards. This retained data will not include any personally identifiable information. 

By using Appyro, you consent to these terms governing the use, display, and rights associated with your User-Generated Content. If you have questions or need further clarification on how your UGC is managed within Appyro, please reach out to our support team at support@appyro.app. 

Account Security, User Responsibilities, and Data Protection 

At Appyro, we prioritize the security of your account, personal information, and survey data. While we take comprehensive steps to protect your data, account security is a shared responsibility. By using Appyro, you agree to protect your login credentials and follow recommended security practices. Please review the following guidelines and responsibilities carefully. 

User Responsibility for Account Security 

You are solely responsible for keeping potential login credentials, including your username and password, secure and confidential. We recommend using a strong, unique password and avoiding reuse of passwords from other accounts. You agree not to share your account information with others or allow unauthorized persons to access your account. Allowing others to access your account may compromise your security and put your personal data at risk. To further protect your account, ensure that any devices used to access Appyro are secure and protected by passwords, biometrics, or other security features. We recommend logging out after each session on shared or public devices. 

Notification of Unauthorized Access If you suspect unauthorized access to your account, please notify us immediately at support@appyro.app. Upon notification, we may take steps to secure your account, such as temporarily disabling access or requiring a password reset. Enabling any additional security features on your device or email provider is also recommended to prevent unauthorized account recovery attempts. In the unlikely event of a data breach that compromises account security, we will notify affected users as required by GDPR and CCPA, detailing the breach and recommended next steps. 

Limitation of Liability 

Appyro is not liable for any loss or damage resulting from your failure to maintain the confidentiality of your account credentials or follow recommended security practices. This includes any unauthorized access to your account due to shared passwords, weak passwords, or lack of device security. While we employ industry-standard security measures to protect your data, no online security method is entirely foolproof. Appyro disclaims liability for any damages resulting from external breaches, hacking incidents, or other security issues beyond our control that do not result from our negligence. 

Data Protection and Security 

To protect your survey data and platform interactions, we collaborate with trusted providers: 

Data from our Singles and Couples Surveys is collected and securely stored with Zoho, which upholds industry standards for data protection and privacy compliance with adherence to standards in accordance with GDPR and CCPA. 

Data processing and analysis occur within Google Cloud’s infrastructure, with encryption both in transit and at rest to ensure robust data protection. Google is also in adherence with international governing bodies and regulations. 

WordPress powers our website for collecting and displaying platform data, and we use secure plugins and regularly monitor this environment to prevent unauthorized access.

User Responsibilities for Secure Behavior 

To maintain account security, we recommend periodically updating your password and avoiding easily guessed options. Be cautious of unsolicited emails or messages asking for account information, and report any suspicious communications to support@appyro.app to help us combat phishing and scams. Appyro will never request your password or account credentials via unsolicited communication. If available, enable two-factor authentication or other security options to enhance account protection. 

Appyro’s Rights to Protect Account Integrity 

Appyro reserves the right to monitor accounts for unusual activity indicating unauthorized access or misuse. If necessary, we may suspend or restrict access to any account suspected of compromise until security concerns are resolved. Should you lose access to your account due to a forgotten password or security breach, Appyro provides account recovery support. You may be required to verify your identity through the email address or phone number associated with your account. Appyro complies with applicable data protection laws and regularly reviews its security practices to uphold the highest standards of data integrity and privacy. 

By using Appyro, you agree to take reasonable measures to safeguard your account and understand that failure to do so may result in unauthorized access, loss of personal information, or account compromise. Appyro is not responsible for damages arising from failure to adhere to these responsibilities, as permitted by applicable law. Prohibited Actions and Grounds for Termination 

At Appyro, we maintain a zero-tolerance policy for any behavior that compromises the safety, respect, and integrity of our community. The following actions are strictly prohibited. If you engage in any of these behaviors, we reserve the right to suspend or permanently terminate your account without a refund. Additionally, where necessary, we will report illegal or dangerous activities to relevant authorities. Your participation on Appyro signifies agreement to these standards and an understanding of our commitment to a safe environment. Appyro reserves the right to interpret and apply these prohibited actions at our discretion. Actions similar in nature to those outlined above may also be deemed violations. 

Prohibited Actions Misrepresentation and Fraud

*Misrepresenting your identity, age, or affiliations, or impersonating any other person or entity. 

*Creating falsified profiles or using fake photos, aliases, or other misleading information. 

*Harassment and Abuse 

*Engaging in harassing, bullying, stalking, threatening, or intimidating behavior toward any user

*Encouraging, endorsing, or glorifying abusive, violent, or discriminatory behavior. 

*Making unwelcome advances, repeatedly contacting users who have requested no contact, or otherwise disrupting another user’s experience.

*Inappropriate and Offensive Content – Posting or sharing offensive, obscene, violent, or pornographic content, including but not limited to images, messages, or media that are overtly sexual, graphic, or violent. Uploading or sharing content that contains explicit nudity or any depiction of illegal activities, self-harm, or abuse. 

*Solicitation and Financial Misconduct Soliciting money, passwords, personal identifying information, or other sensitive data from users. Engaging in fraudulent activities, scams, or illegal financial schemes, including but not limited to money laundering, pyramid schemes, and deceptive solicitations. 

*Advertising, endorsing, or promoting any political campaign, business, or commercial service without prior permission from Appyro. 

*Hate Speech and Discrimination Promoting, endorsing, or engaging in racism, sexism, bigotry, hate speech, or any language or behavior that targets individuals or groups based on race, religion, sexual orientation, gender, national origin, or disability. Sharing content that incites violence, hostility, or discrimination toward any individual or group. 

*Privacy Violations: Sharing, distributing, or posting another user’s personal information or any private information that could identify an individual (such as names, addresses, phone numbers) without their explicit consent. Using Appyro’s services to gather personal data on users for any unauthorized purposes, including data scraping or phishing activities. 

*Unauthorized or Harmful Activities Attempting to hack, disrupt, or otherwise interfere with the functioning of Appyro, including the use of bots, crawlers, or automated services. Using Appyro for any criminal activity, solicitation of illegal activities, or to create or spread malware, viruses, or malicious content. 

*Attempting to bypass Appyro’s security measures or restrictions in any manner or accessing restricted parts of the platform, Appyro’s back-end infrastructure, or other users’ accounts without authorization. 

*Creating new accounts after being suspended or terminated due to violations of these Terms. . 

Grounds for Immediate Termination 

Appyro takes user safety very seriously. Any activity that violates U.S. and European law, poses a danger to other users, or undermines the integrity of our platform will result in immediate account termination without notice or refund. This includes, but is not limited to, any form of criminal activity, serious harassment, hate speech, and unauthorized access attempts. Users may request a review of their termination by contacting support@appyro.app. However, Appyro reserves the right to uphold termination decisions for serious violations. 

Appyro reserves the right to investigate and take necessary action, including reporting illegal activities to law enforcement, as appropriate. Any attempts to compromise or interfere with Appyro’s infrastructure, including hacking, unauthorized access, or distribution of malicious content, will result in immediate termination and potential legal action. 

By using Appyro, you acknowledge and agree to these standards. Engaging in any prohibited actions will not be tolerated, and Appyro is committed to maintaining a safe, respectful, and trusted environment for all users. Appyro reserves the right to remove any content that violates these standards, with or without terminating the user’s account, as deemed appropriate. Violations resulting in immediate account termination will not be eligible for a refund, in accordance with Appyro’s zero-tolerance policy.” 

Service Availability and Downtime 

At Appyro, we are committed to providing reliable and uninterrupted access to our platform. However, we cannot guarantee continuous availability, and there may be occasions when access to Appyro is temporarily unavailable due to maintenance, updates, unforeseen technical issues, or factors beyond our control. Please review the following terms regarding service availability and potential interruptions. 

Scheduled Maintenance and Updates 

We periodically perform scheduled maintenance and updates to enhance functionality, improve security, and introduce new features. These updates may result in temporary downtime or limited access to certain features. Where possible, we will inform users in advance of scheduled maintenance and work to minimize disruption. Where possible, we will inform users in advance of scheduled maintenance via email and will work to minimize disruption, pausing the site and releasing updates during lowest volume periods. 

Unexpected Disruptions 

In the event of unexpected technical issues, server outages, or circumstances outside of our control (such as internet service provider disruptions, cyberattacks, or natural disasters), Appyro may experience temporary downtime. We will make every effort to resolve these issues promptly and restore full functionality as soon as possible. While we aim to keep our platform accessible at all times, we cannot guarantee that Appyro will be free from interruptions or disruptions. During periods of downtime, Appyro prioritizes the protection and integrity of all user data, implementing secure recovery procedures to restore access and functionality safely. 

Limitations of Liability 

Appyro disclaims liability for any issues resulting from service interruptions caused by both external factors (e.g., internet outages, cyberattacks) and internal factors beyond our reasonable control (e.g., infrastructure failure). Appyro is not liable for any losses, damages, or inconveniences you may experience due to temporary downtime, maintenance, or service interruptions. This includes, but is not limited to, any impact on user matches, communications, or interactions that may be delayed or unavailable during periods of downtime. Appyro is not liable for missed or time-sensitive interactions that may be affected by downtime, including delays in matches or communications. While we strive to restore service quickly, Appyro disclaims liability for any issues arising from interruptions due to external factors or events that are beyond our reasonable control. 

User Responsibility and Awareness 

By using Appyro, you acknowledge and accept that the platform may be occasionally unavailable for maintenance or due to unforeseen issues. We encourage users to be mindful of this when planning or scheduling interactions on the platform. If you experience extended issues accessing your account or the Appyro platform, please contact our support team at support@appyro.app for assistance, and we will do our best to address your concerns. 

Future Service Enhancements 

Appyro is continually evolving, and we may update, modify, or enhance our platform’s features and services to improve your experience. While we work to implement these changes smoothly, there may be brief interruptions as new updates are rolled out. We appreciate your patience and understanding as we strive to provide the best service possible. By using Appyro, you agree that temporary disruptions or unavailability of service are a part of operating an online platform, and you acknowledge that Appyro will not be held responsible for any losses or inconveniences arising from such interruptions. Our team is committed to restoring access promptly and keeping users informed of any significant issues that may affect availability. 

User Rights Regarding Data Access and Control 

At Appyro, we respect your privacy rights and comply with applicable data protection laws, including the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR). As a user, you have the right to control your personal data and make informed choices about how it is used. Please review the following options for accessing, managing, and removing your data. 

Right to Access Your Data 

You have the right to request access to the personal data that Appyro has collected about you. This includes data provided directly by you (such as profile information, survey responses, and user-generated content) and data derived from your interactions with the platform (such as activity logs and engagement metrics). Upon receiving your request, Appyro will provide a copy of your data in a portable format within a reasonable timeframe, typically within 30 days, in accordance with applicable laws. 

Right to Correct or Update Your Data 

You may request corrections to any inaccurate or incomplete personal data we have collected. This allows you to ensure that your profile and information remain accurate and up-to-date. 

Right to Delete Your Data 

You have the right to request the deletion of your personal data. If you decide to stop using Appyro or no longer wish to have your data processed, you may contact us to request deletion. Upon receiving your request, we will permanently delete or anonymize your personal data, except where retention is required for legal compliance, fraud prevention, or system backup purposes. 

Right to Opt Out of Data Processing for Specific Purposes 

You have the right to limit or opt out of certain types of data processing, such as data used for marketing, analytics, or promotional purposes. This includes the right to withdraw consent for data processing if you previously agreed to optional processing activities. Changes to your data processing preferences will take effect within a reasonable timeframe, typically within 14 days of your request. Right to Restrict Data Processing 

Under GDPR, EU users have the right to object to specific types of data processing, including direct marketing, profiling, and automated decision-making for matchmaking. All users may request that we restrict the processing of your personal data under certain circumstances, such as if you dispute the accuracy of your data or if the data processing is unlawful. During any restriction period, we will limit the processing of your data to only essential purposes. 

Exercising Your Data Rights 

To exercise any of the rights outlined above, please contact our support team at support@appyro.app with your specific request. We may require verification of your identity before processing data access or deletion requests to protect your privacy and the security of your data. Appyro will not discriminate against you or deny service based on exercising your data rights under CCPA, GDPR, or any applicable laws. Please note that exercising certain rights, such as the right to delete or restrict data processing, may impact your access to some features of the Appyro platform. 

Data Retention and Legal Compliance 

Appyro retains personal data only for as long as necessary to fulfill the purposes for which it was collected, as required to provide our services, or as needed to comply with applicable legal obligations. Upon account deletion, any retained data will be stored securely and used solely to meet compliance obligations or resolve disputes, after which it will be permanently deleted or anonymized. By using Appyro, you acknowledge these rights and our commitment to uphold them in compliance with applicable privacy laws. Age Restrictions and Eligibility 

Appyro is designed exclusively for adults seeking meaningful connections, whether through our matchmaking platform for singles or our Sweetstakes program for couples. To maintain the integrity, safety, and purpose of our community, we enforce strict eligibility requirements as outlined below: 

Minimum Age Requirement 

Appyro is intended solely for users aged 18 and older. By registering or using our platform, you confirm that you are at least 18 years of age. This age restriction applies across all of Appyro’s services, including both the singles matchmaking platform and the Sweetstakes program for couples. Appyro reserves the right to verify the age of any user at any time. If we discover that a user under the age of 18 has accessed our platform, we will immediately terminate their account and remove any associated data, except as necessary to comply with legal requirements. Attempting to bypass age restrictions by providing false information will also result in termination. If we discover that a user under the age of 18 has accessed our platform, we will terminate the account and remove associated data within 5 business days of discovery, except as necessary for compliance with legal requirements.” 

Eligibility for Singles Matchmaking Platform 

The singles matchmaking platform is open only to individuals who meet our age requirements and have a genuine intent to seek a new connection. Users are encouraged to be honest with themselves and others, including any current partners, and should not join Appyro unless they are sincerely interested in exploring new relationships. Users must provide truthful and accurate information about themselves, including age, gender, and relationship goals Users may only create one account on the Appyro singles platform. Any user found to have falsified personal information, including relationship status or age, may face permanent termination from the Appyro platform, including any related accounts. 

Eligibility for Sweetstakes Program for Couples 

The Sweetstakes program is exclusively for couples in committed relationships. By participating in Sweetstakes, users affirm that they are currently in a genuine, committed relationship and have provided accurate information regarding their status. If a couple’s relationship status changes, both individuals are responsible for notifying Appyro directly at support@appyro.app so we can update our records. Couples who submitted the couples survey and subsequently experienced a status change may continue participating in the Sweetstakes, provided they make an effort to update their records during this time. 

Appyro reserves the right to request proof of relationship status, and users will be notified of proof requirements in advance. Acceptable forms of proof may include joint documents, photos, or declarations. Failure to provide satisfactory proof of relationship status upon request may lead to suspension or termination from the program. If it is discovered that a couple has falsified their relationship status or provided misleading information to participate in the Sweetstakes program, Appyro reserves the right to immediately terminate their account and disqualify them from any current or future Sweetstakes offerings. This termination applies even if one partner provides false information without the other’s knowledge. 

Ongoing Eligibility Monitoring 

Appyro regularly monitors account activity to ensure compliance with eligibility requirements. If we suspect any user of providing false information, violating age or relationship eligibility, or otherwise breaching our Terms, we may temporarily suspend the account while conducting a review. Following the review, accounts found to be in violation will be terminated. Users who believe their account was terminated in error may contact our support team at support@appyro.app to provide additional information or request an appeal. Appyro will review appeals on a case-by-case basis and aims to provide a response within 10 business days of receiving the appeal request. 

Legal Compliance and Data Retention 

In cases of account termination for violation of age restrictions or eligibility requirements, Appyro will remove the account and delete associated data except where retention is necessary for legal compliance, dispute resolution, or enforcement of our Terms. If we have reasonable cause to believe that an individual’s eligibility violation involved fraudulent or illegal behavior, we may report such activity to appropriate authorities as required by law.Fraudulent or illegal behavior includes, but is not limited to, identity theft, impersonation, or providing falsified documents. Appyro reserves the right to report such actions to relevant authorities.

By using Appyro, you agree to receive occasional communications related to matches, platform updates, and other relevant information to enhance your experience. Appyro respects your communication preferences and complies with applicable privacy laws, including the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), which provide you with control over your communications and personal data. 

Types of Communications Essential Communications: Certain communications are necessary to provide you with Appyro’s core services and cannot be opted out of. These include: Account-related notifications (such as password changes, security alerts, and account updates) Notifications directly related to your matchmaking activity or participation in the Sweetstakes program Service or policy updates that impact your use of the platform

By registering with Appyro, you provide consent to receive both essential and non-essential communications as part of our service. We collect and use your contact information in accordance with our Privacy Policy and data protection regulations, including GDPR and CCPA. Your consent for non-essential communications is optional and can be withdrawn at any time, as detailed below. 

Opting Out of Non-Essential Communications 

At the moment, we will not be sending any non-essential communications. However, once we do, we respect your right to opt-in and opt-out of such emails and notifications.. We will provide the option to unsubscribe at Click the “unsubscribe” link included at the bottom of any promotional email, or you can contact our support team at support@appyro.app to adjust. 

Upon receiving your opt-out request, Appyro will process it within 10 business days, ensuring that your preferences are updated promptly. Please note that, per GDPR and CCPA requirements, opting out of non-essential communications does not affect your ability to receive essential communications necessary to operate your account. 

Impact of Opt-Out on Service Experience

 Opting out of non-essential communications may prevent you from receiving feature announcements, profile tips, relationship insights, or special offers that enhance your Appyro experience. Essential service notifications will remain active to support your account’s functionality. Your decision to opt out of non-essential communications will not impact your account standing or your access to essential services on Appyro.

All communications are managed in compliance with GDPR, CCPA, and our Privacy Policy, ensuring that your data is handled responsibly and securely. We do not share your contact information with third parties for marketing purposes without your explicit consent. You retain the right to access, delete, or modify your communication preferences at any time as outlined in our Privacy Policy. By agreeing to Appyro’s Terms, you acknowledge and accept these communication guidelines and understand your right to modify your preferences under GDPR and CCPA. Compliance with U.S. and International Laws Appyro operates in compliance with applicable U.S. federal, state, and international laws and regulations, including the Federal Trade Commission (FTC) guidelines on data security and consumer protection. We are committed to transparency and to providing a secure, lawful environment for our users. 

In line with FTC guidelines, we take proactive measures to secure your personal data and provide clear, honest information about our practices. We aim to provide users with transparency regarding data usage, privacy, and security. We strictly adhere to the Children’s Online Privacy Protection Act (COPPA) and do not knowingly allow users under the age of 18 to register, access, or use Appyro’s services. In compliance with COPPA and our age restriction policy, Appyro is exclusively for users 18 and older. If an underage user is identified, their account and data will be immediately deleted. 

Although Appyro’s primary services are currently available only to U.S. customers, we comply with the data protection principles outlined in GDPR. Any personal data collected through surveys or platform interactions is handled in line with these regulations, giving users rights to access, correct, or delete their data as detailed in our Privacy Policy. Appyro’s singles matchmaking platform is currently limited to U.S.-based customers, with future expansions to be considered. However, Appyro’s surveys may be accessible internationally, including within the European Economic Area (EEA), and we comply with GDPR guidelines for survey participants. By using Appyro, you agree to these geographic restrictions. 

Modifications to These Terms 

Appyro may update or modify these Terms from time to time to align with changes in services, legal requirements, or operational practices. We will notify users of any substantial changes through in-app notifications, email, or other direct communication methods. Substantial modifications involve significant changes to user rights, fees, or Appyro’s core services. Minor updates may include clarifications or formatting adjustments that don’t impact terms. Where practical, we will provide at least 30 days’ notice before implementing significant changes to these Terms. Minor updates or clarifications may be made without advance notice but will always be highlighted in the most recent version of the Terms. 

By continuing to use Appyro’s services after any changes are communicated, you acknowledge and accept the revised Terms. We encourage all users to periodically review our Terms to stay informed of any updates. If you do not agree with any modifications to these Terms, you may choose to discontinue your use of the Appyro platform. Governing Law and Jurisdiction 

These Terms are governed by the laws of the United States and the state of New Mexico. By using Appyro, you agree that any disputes, claims, or legal proceedings related to these Terms or your use of Appyro’s services will be governed by the laws of New Mexico and subject to the jurisdiction of the courts located within New Mexico. This applies to both U.S.-based users and any international users accessing Appyro’s services from outside the United States. Any disputes, claims, or legal proceedings related to these Terms or your use of Appyro’s services will be governed by the laws of the United States, and will be subject to the jurisdiction of the courts located within the United States. 

While Appyro’s services are primarily intended for the U.S.-based users, Appyro acknowledges its responsibility to comply with international data protection laws, including GDPR, for users accessing certain parts of the platform (such as surveys) from outside the U.S. Any claims or disputes involving international users may be subject to applicable data protection laws and relevant jurisdictions as needed. By accessing Appyro’s services from outside the U.S., including surveys, you agree to the application of U.S. laws and jurisdiction to any related disputes. 

Where legally permissible, users agree to resolve any claims, disputes, or controversies arising from or relating to Appyro’s services through binding arbitration rather than in court. By using Appyro and agreeing to arbitration, users waive the right to a jury trial and to participate in any class actions for claims, whether resolved through arbitration or otherwise. 

Appyro Sweetstakes Loyalty Program 

As a thank you to individuals in committed relationships who are participating in making relationships more accessible for all, we have created a loyalty program that offers gift cards and experiences to help further relationships of all stages. 

Eligibility

The Appyro Sweetstakes Loyalty Program (the “Program”) is open only to individuals who are at least 18 years old at the time of entry, and who are in a committed relationship. 

The Program is available to legal residents of the United States in jurisdictions where sweepstakes are legally permitted. While legal residents of the European Union are able to submit the Couples Survey, they unfortunately will not be permitted to enter the Sweetstakes at this time. Appyro is not responsible for monitoring where you are when attempting to enter the Program, however we will ensure entry only from applicants in participating regions. Thus, participation is void where prohibited by law. 

Employees, contractors, and affiliates of Appyro (the “Company”), as well as their immediate family members, are not eligible to participate. 

Program Overview 

The Appyro Sweetstakes is a sweepstakes that encourages eligible participants to share insights about their relationships. Participants gain entries by completing a specific survey related to their relationships or by submitting a mail-in form. 

Participation Period 

The Program begins on November 1st and will continue until December 31st as otherwise determined by Appyro (the “Participation Period”). 

Odds of winning depend on the number of eligible entries received during the Participation Period. If there are not 100 entries submitted by the end of the Participation Period, only secondary prizes will be awarded (not the ultimate grand prize). 

Each eligible participant may enter once by completing the Couples Survey or via mail-in entry (see ‘How to Enter’).

How to Enter

Survey Entries: Individuals who submit the Couples Survey will automatically be entered into the Program, with no additional actions needed. Eligible participants may only enter once. The surveys must be fully completed to qualify, and the participants must allow their data to be used for matchmaking. 

Mail-In Entry: As an alternative to survey entries, eligible participants may also enter by mailing a handwritten to: [500 4th St NW, Suite 102, Albuquerque, NM 87102) including their full name, mailing address, email address, and a statement: “I am entering the Appyro Sweetstakes.” If selected as a winner, you will need to submit photographic evidence of your relationship to support@appyro.app. Limit one mail-in entry per person. 

All entries, whether by survey or mail, must be received by 11:59 PM (ET) on December 31, 2024 to be eligible for the Program. 

Monthly Drawing 

On or within 24 hours of January 7th, a random drawing will be conducted from all eligible entries received during the previous month. 

Winners will be selected randomly and will be notified via email within four days of the drawing. 

Winners must respond within 72 hours to claim their prize. 

Prize Information: 

There will be one grand prize package of a feature on our social media, a couples-oriented gift basket (minimum value of $50, maximum of $100), and a paid dinner for two of a cumulative value no less than $100 and up to $250. Appyro will also allocate a per diem of $50 for transportation and services (provided in form of Visa Gift via email) needed to ensure the couple can attend to dinner in peace. 

Winners may also elect to replace the gift basket, paid dinner, and per diem for a gift-card valued at $350. Couples may choose to opt-out of the feature on social media.The Company is not responsible for what the per diem is used on, nor for the experience at dinner or in transit to or from the dinner. The Company will provide a list of five preferred restaurants for the winner to select from within a 20 mile vicinity of the applicants. If none of the options appeal to the winner, the winner may recommend one or two additional options. If the Company and the winner cannot come to the agreement, the winning prize will default to the $350 cash reward. 

As runner-up prizes, there will also be 5 $20 gift cards to local establishments. The Company reserves the right to substitute a prize of equal or greater value at its discretion. Any substitution of a prize of equal or greater value will be communicated via email. 

Winners are solely responsible for reporting and paying any applicable taxes on their prize earnings, as required by law. 

Aside from listed exceptions or exchanges – all prizes are non-transferable, non-exchangeable, and non-refundable. No cash alternatives will be provided. 

Entry Limits

Participants are limited to one entry in the Participation Period, regardless of entry method. For a greater chance at sharing a prize with your significant other, you are encouraged to have your significant other participate and enter as well. Any attempt to submit fraudulent entries, including falsifying survey responses, using multiple identities, or submitting false information, will result in disqualification. 

Privacy and Data Usage

By entering the Program, participants consent to the Company collecting and using their survey responses for research, analysis, and other business purposes related to improving relationship-based services. Any request to no longer leverage data for research or remove their information from our database will result in a removal from the Program. 

Winners may be subject to a release of name and likeness if required by law, however will have the ability to opt-out to be featured from promotional content. Data submitted for Program entry will be retained for the duration of the Participation Period and as required for regulatory purposes, after which it will be anonymized or deleted 

As per GDPR and CCPA Law, Appyro may retain anonymized data as required for regulatory or audit purposes. Personal information collected as part of the Program will be managed per the Company’s Privacy Policy. 

Limitation of Liability 

By participating, entrants agree to release and hold harmless the Company, its affiliates, employees, and agents from any liability, injury, loss, or damage caused by or arising out of participation in the Program or the acceptance, use, or misuse of any prize. 

Appyro will strive to maintain technical excellence; however, entrants waive claims arising from any unforeseen technical issues, including lost, delayed, incomplete, or misdirected entries due to technical problems outside Appyro’s control. Appyro is not responsible for any technical malfunctions, failures, or delays in entry submissions resulting from internet service provider issues, device compatibility, or other technical factors beyond Appyro’s reasonable control. Appyro is not responsible for what happens when leveraging the prizes – only for administering rewards.

General Terms 

The Company reserves the right to modify or terminate the Program at any time for any reason. Examples include, but are not limited to, acts of God, unforeseen technical issues, regulatory changes, financial restraints, or activities that tarnish the integrity of the program. 

These Terms and Conditions constitute the entire agreement between the participants and the Company regarding the Program and supersede any prior agreements or understandings. Appyro reserves the right to modify or update Program rules at its discretion. Any changes will be posted to the Program Terms & Conditions, and continued participation in the Program constitutes acceptance of updated rules. 

Disputes and Governing Law 

This Program is governed by the laws of the United States, without regard to conflict of law principles. By participating in the Appyro Sweetstakes and using any services provided by Appyro, you and Appyro agree that any dispute, claim, or controversy arising out of or relating to the Program, these Terms & Conditions, or any other aspect of your relationship with Appyro will be resolved through binding arbitration rather than in court, except for matters that may be brought in small claims court. By agreeing to arbitration, you and Appyro each waive the right to a jury trial or to participate in a class action. All claims and disputes must be arbitrated on an individual basis. Neither you nor Appyro may join or consolidate claims by or against others in any arbitration, nor participate in any representative or class proceeding, except as required by law. Notwithstanding the above, either party may seek injunctive or equitable relief in court for matters related to intellectual property rights, unauthorized access to or misuse of the platform, or any other matters for which injunctive relief is permitted by law. This Arbitration Agreement is governed by the Federal Arbitration Act. The arbitrator’s award will be binding and may be entered as a judgment in any court of competent jurisdiction.
